PARTICULARS OF THE ORGANISATION, FUNCTIONS AND DUTIES.   

INTRODUCTION

                           It was under the ‘British- Raj’ during the 1940’s that the Prison System was introduced in the State. The 1st Jail, ‘Kohima Jail’ was opened by the then British Government at ‘Old Jail Hill’, the present site of District Jail Kohima during the post IInd World War. Prison Department is perhaps one of the oldest Departments in the State.

The Prisons Department functions under the Home Department headed by the Home Commissioner as Administrative Head of Department. Home Department take up matters forwarded by the Prisons Department in regard to recruitment of officers, promotions, departmental policies and all major matters relating to the department. All correspondences with the Government, Central and State are done through the Home Department.
The Prison Department is a small organization with a total strength of 832 (eight hundred and thirty two) employees. Yet, it is a very sensitive Department as it deals directly with human problems.

Initially ‘Jail’ was an Institution where offenders were kept separated from the society while awaiting trial or to serve the term sentenced under the law. With the passage of time the need for more Jails was felt and thus branches from the lone Kohima Jail were set up. Today, Nagaland Prison Department have 11 Jails covering 10 Districts of the State with the largest Jail Central Jail situated at Dimapur, 3 (three) District Jails (Kohima, Mokokchung and Tuensang), 7 (seven) Sub-Jails (Phek, Peren, Dimapur, Kiphire, Zunheboto, Wokha and Mon).

The Department of Prison is Headed by a Senior IPS Officer in the rank of Director General of Police (Prison) assisted by various level of functionaries.

With advancement, Prison System has also changed. Prison, today is a correctional Institution where the Inmates were given chances to reform and also the know how to earn a livelihood with the introduction of Handicrafts, Tailoring. Tea Plantation, Gardening, Music Classes etc. Chapels were setup within the Jail premises and Church Services were conducted. Baptisms were given, confessions were heard and Praise and worship services were held regularly.

With objectives of Justice and Correction, official visitors, Non- official visitors, church bodies and various NGO’S were welcomed to have interaction and fellowship with the inmates. Specialized speakers and Preachers in various fields were invited to address, encourage and enlighten the inmates.
 

 

OBJECTIVE

                           To ensure smooth functioning of the prison department and management of matter relating to prisoners’ problem.

 

FUNCTIONS

1.      Requisitioning of Asstt. Jailor onward to executive officers (NJS) Post to NPSC for recruitment.

2.      Forwarding of proposal to Home Commissioner for promotion, transfer and posting of Gazetted Officers.

3.      Promotion, Transfer and posting of Gr. III and Gr. IV Staff.

4.      To appoint Gr. IV staff as when vacancies arises.

5.      To take disciplinary action against erring employees.

6.      Court cases pertaining to writ petition in the department.

7.      Construction matter.

8.      Trainings.

9.      Creation of post.

10.  GPF, MR and MA.

11.  Expenditure, sanction of the department.

12.  Budget.

The Director General of Prisons is the head of the department. He is responsible for overall administration and activities. Major policies of the Department were forwarded to the government.

Superintendent of Jail (HQ) supervise and co-ordinate between the department and various jails. He looks after the establishment and screening and analyzing the files before putting up to higher authority.

Superintendent of Jails is overall in-charge of his respective Jail. He is responsible for safe custody of inmates and shall manage the Prison in all matters relating to discipline, expenditure, punishment and control of the employees and the prisoners. All officers must observe proper chain of command.

Jailor is the Chief Executive Officer of the Jail. He is responsible for safe custody of the inmates and ensures that proper disciplines are maintained.

Chief Head Warder is responsible for enforcement of strict discipline and security of the jail in all respect. All locks and keys of the prisoner’s cells and kitchen are kept under his custody. He also looks after duty detailment of Head Warders, Warders, Female Warders, Sweepers and water carrier and maintains the records of such duties. Chief Head Warder is assisted by Head Warder.

The Head Warder shall be in-charge of all the warders in duty in its particular shift. He shall be responsible for the smartness and cleanliness of the warder and their being at all times and also see that the warders are properly dressed and performing their duties efficiently.

Warder in charge of a ward or set of wards to see that the prisoners maintain cleanliness and also to examine the wards, cells of the prisoners and to report immediately to the Jailor of any sign of sickness or any prisoners complaining sickness.

The female warder shall have the entire care of the female prisoners. She should be present at the opening of the female wards and during lock-up and also to see that no male prisoners enter the female wards unless accompanied by an authorized jail officers.

Regional Probation Officer has to control, guide and supervise the work of probation in the area within his jurisdiction. He is responsible to co-ordinate between the court and prisoners. His prime duties are to have close contact with the prisoners and depending on their behavioral attitude can recommend for release of prisoners on parole.

Research Officer is responsible for the developmental activities of the department since the prison department do not have engineering wing of its own, he has to co-ordinate with the executive agency i.e. CAWD for preparation of schemes under Plan Sector and Centrally Sponsored Schemes. The department has its Head Quarter at Kohima (Prisons HQ) headed by D.G.P. The Decision making in respect of prisons department is vested with the D.G.P. All the paper relating to establishment matter are generally processed initially at the level of L.D.A., U.D.A. who put up file to the Asstt. Superintendent and Superintendent. The Superintendent sends up the file after scrutinized the matter through A.I.G, D.I.G, I.G.P. In certain cases of the service matters is advice to D.G.P. for approval. No Officers is authorized to take arbitrary decision of his own in all matters.

            Besides directorate of prison have three types of jails such as, Central Jail, District Jail and Sub-Jails. These three sub-offices is headed by Superintendent within the respective jails.

            The D.G.P. (Prison) supervises the over all administration programmes and policies.

            The officers and staff of the prison department are accountable for timely disposer of works assigned to them.

Section4 (1)(b)(iv):

THE NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS:-    

Directorate of Prison, Government of Nagaland does not have separate Jail Manual. Therefore, Nagaland Jails follows the analogy of Assam Jail Manual basing on the legal powers and responsibilities as empowered to Prison Act. The various norms to discharge various functions at different levels are spelt out in detail by the Assam Jail Manual for various ranks from constable to DGP which is followed by the department. Besides these, norms for discharge for functions, responsibilities and powers are governed by various government rules and regulations, notifications, Act etc while discharging official and lawful functions, officers should ensure that their decisions and actions are not in contravention to the government servant conduct rules and legal functions.
