HOME BRANCH, HOME DEPARTMENT
The particulars of its organization, functions and duties;
Home Branch deals with:-
(1) Jails, Sub Jails,
(2) Prisons Acts and Rules,
(3) Remission and Commission of sentence,
(4) Matter Relating to Scheduled Castes/Scheduled Tribes,
(5) Centre and Inter State Council,
(6) Official language of the State,
(7) Recognition of Local Tribes and Dialect.
Functions:-
(1) Prison Department:-
(a) Promotion, transfer posting, disciplinary action etc of officers of Prisons Department and promotion of ministerial staff of Prisons department, and disciplinary action etc.
(b) To send requisition to NPSC for recruitment to the post of Assistant Jailor for Prison department as and when vacancy arises,
(c) Formulation of schemes for modernization of Prisons and implementation of the Schemes,
(d)To ensure proper administration of Jails and Sub-Jails,
(e) To ensure that cases of under trial prisoners are tried and disposed off on time, and
(f) To ensure that the remission and commutation of sentences were disposed off on time in order to avoid unlawful confinement of any of the convict
(2) Matter Relating to Scheduled Castes/Scheduled Tribes,
(1) Prevention of Atrocities Act & Prevention of Civil Rights Act.
(2) Implementation of National Commission for Scheduled Caste & Scheduled Tribes Recommendations.
(3) Minorities’ issues relating to recognized of Minorities tribes/ Minority Commissions, Minorities Welfare, Linguist Minorities etc.
(4) Matters relating to recognition of Indigenous Inhabitants and Scheduled Tribes/ official language.
(5) Implementation of the reports of the SC & ST.
(6) Matters relating to De notified, Nomadic & Semi Nomadic Tribes
(7) Matters relating to State Wakf Board.
(8) Implementation of Prime Minister`s 15 point Programme.
(9) Implementation & Monitoring of Matters relating to Centre- State Relations
(10) Implementation & Monitoring of ISC recommendations.
The powers and duties of its officers and employees
a. UDA /LDA: - They examine and process all the papers and cases received by the branch, maintain files and also looks after receipt and dispatch of daks.
b. Typist: - Concerned with all typing matters,
c. Peons: - Act as assistant in the Branch in handling files and delivering files messages and information
Branch Superintendent: - Branch Superintendent supervises and controls the working system of the whole branch and maintains the attendance of the Staffs in the Branch in order to cultivate work habit and to implement the Govt. Policy of No work No pay.
Under Secretary (Home): All the files and daks go through the Under Secretary of the Branch and after going through the files, Under Secretary will give the clear picture of the subject matter and will put up to higher authority for final decision. Under Secretary also recommend the Casual Leave and any other kind of leaves for the Staffs. Files which are approved by Home Commissioner are disposed off by the Under Secretary.
Addl. Secretary (Home): All the files routed through Additional Secretary (Home) and after thorough study of the files, Additional Secretary will again correct or rectify the subject matter where the under Secretary misses the point and will submit to Secretary (Home) in order to check the lapses if any.
Secretary (Home): All the Files routed through Secretary and if any changes are to be made Secretary will send back the file with suggestions so that when the file reaches Home Commissioner the clear picture of the subject matter is projected.
Home Commissioner:- In Routine office work the final decision is taken by Home Commissioner.
Minister in charge of Jail: - All the Policy matters are put up to Minister in charge of Jail for final decision.
Cabinet:-Important policy matters are put up to Cabinet for approval.
The procedure followed in the decision making process, including channels of supervision and accountability;
In routine establishment matters the final decision making in Home Branch is vested with Home Commissioner but all the policy matters are put up to Minister in charge of Jail and to Cabinet for final decision. All the papers relating to the Home Branch are processed in files by the dealing assistant who submit the file to Branch Superintendent who in turn submit to the Under Secretary- Additional Secretary-Secretary – Home Commissioner, policy matters to minister Jail and Cabinet.
The dealing Assistant put up the matter by giving the gist of the content which will be checked by the Branch Superintendent and other officers under Home Commissioner. In some cases files are endorsed to P&AR and Justice & Law Department for their views and comments before taking final decision on the matter.
Home Commissioner Supervise over all administration and functioning of the Home Branch and the Branch Superintendent supervise the functioning of the branch.
All the officers and Staffs are accountable for timely discharge of papers/files and duties assigned to them and are accountable for their negligence.
The norms set by it for the discharge of its functions;
In discharging its functions the Home Branch follows the norms set by the Government of Nagaland in the Nagaland Manual of Office procedure. Besides other Guidelines , Orders, Memorandums, Acts and Rules and Regulations issued by the State Government and Central Government from time to time is followed.
The rules, regulations, instructions manuals and records, held by it or under its control or used by its employees for discharging its functions;
In discharging its functions, Home Branch follows the norms set by the Government of Nagaland in 1. Manual of office Procedures,

3. Delegation of Financial and Cognate Power 1964,
4. Leave Rules 1972,
5. General Provident Fund Rules;
6. The Nagaland Government Servant Conduct Rules 1968
7. Suspension and Reinstatement,
8. Fundamental Rules and Supplementary Rules,
9. General Financial Rules
10. Procedure in Departmental inquiries,
11. The Nagaland Service (Discipline and Appeal Rules, 1967),
12. Pension Rules, and other Rules, and Regulations issued by the State Govt. and Central Govt. from time to time.

The Home Branch manage the official documents as per the norms laid down by the Government. Such as, Govt. Orders, Sanctions, Notifications, Memorandums, Minutes, Report files, Establishment Files, Receipt and Dispatch. Besides Daily attendance Register is maintained by the Branch Superintendent.

1. Purchase Board:-
The Board consists of the following members:-

The Purchase Board meets once in a year for supply of Dietary and allied articles to various Jails in the State. Its meetings are not open to the public but its minutes are accessible.

The Sentence Review Board is to meet at least once quarterly to recommend the case of the convicts who are completed 14 yrs of imprisonment for premature release. The meetings are not open to the public.

Home Branch follows the various guidelines, Rules and regulation laid down by the State Government and Central Government in discharging its official work and in case of any changes in the Rules and Regulations, department update the new guidelines as prescribed by the State Government and Central Government and implement it accordingly.
